§ 18-202. Determination of object.

  • In determining whether an object is drug paraphernalia, a trier of fact should consider, in addition to all other relevant factors, the following:

    (1)

    Instructions, oral or written, provided with the object concerning its use;

    (2)

    Descriptive materials accompanying the object which explain or depict is use;

    (3)

    National and local advertising concerning its use;

    (4)

    The manner in which the object is displayed for sale;

    (5)

    The existence and scope of legitimate uses for the object in the community; and

    (6)

    Any expert testimony which may be introduced concerning its use.
