§ 8-19. Definition of auction; exceptions.

  • (a)

    The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Auctions means every person who shall at public outcry offer for sale, either as principal or agent and whether full time or for relief of another, to the highest bidder on the spot, any article of merchandise or property, shall be deemed an auctioneer, and every such sale shall be deemed an auction.

    (b)

    Nothing in this article shall apply to judicial sales or to sales by executors, administrators or trustees under court order, or to the state, any political subdivision thereof, municipal corporation or quasi-municipal corporation auctioning its own property.
