§ 2. Purpose, policy and scope.

  • This Ordinance is adopted under the municipal authority of the city and for and on behalf of the state of Oregon to carry out the purposes of ORS Chapter[s] 459 and 459A and the State Solid Waste Management Plan in order to protect the health, safety, welfare and environment and to conserve energy and natural resources within the city; to provide the opportunity to recycle; to protect against improper and dangerous handling of hazardous wastes; and to otherwise provide for solid waste management. It is declared to be the public policy of the city to regulate solid waste management to:

    A.

    Establish priorities on managing solid waste to reduce the amount of solid waste generated; reuse material for the purpose for which it was originally intended; recycle the material that cannot be reused; compost material that cannot be reused or recycled; to otherwise recover material where possible; and to assure that the remaining wastes will be disposed of in a manner that fully meets all requirements of state law and the Department of Environmental Quality;

    B.

    Provide the opportunity to recycle as part of the overall solid waste collection system by taking advantage of coordinated area-wide service, promotion, education and marketing;

    C.

    Encourage research and demonstration projects in recycling, reuse, composting, resource recovery and solid waste management generally by and through the franchisee with technical assistance of other persons;

    D.

    Ensure safe, economical and comprehensive solid waste service;

    E.

    Ensure rates that are just, fair, reasonable and adequate to provide necessary public service and to prohibit rate preferences and other discriminatory practices;

    F.

    Provide for technologically and economically feasible reuse, recycling and other resource recovery;

    G.

    Provide standards for solid waste service and public responsibilities;

    H.

    Prevent overlapping service to reduce truck traffic, street wear, air pollution and noise;

    I.

    Insure maintenance of a financially stable, reliable solid waste collection, disposal and resource recovery service.
