§ 3. Franchise Subject to Regulatory Ordinance.

This franchise ordinance is subject to, and subservient to the exercise of the police power to regulate the health, safety, and welfare within the City, as now enacted, or as they may be amended during the term of this franchise. Furthermore, nothing contained herein shall operate as a limitation on the legislative power of the City Council of Independence to regulate activities occurring within the public rights-of-way.
