§ 32. Reports and Records.

  • A.

    Within ninety (90) days after the close of the Franchisee's fiscal year, Franchisee shall file with the City the following reports pertaining to the Franchise area:

    1.

    Total number of customers at the end of the fiscal year.

    2.

    Outline of plans for improvement of the service in the next fiscal year.

    3.

    The financial status of the solid waste management and recycling service, using an acceptable format. Financial information shall include, but not be limited to, the following reports: balance sheet, income statement, statement of applications of funds, statements of current and projected customers and penetration in the Franchise territory. All such reports are to reflect the operation of the franchisee's total service area for solid waste management and recycling service. This report shall be signed by an authorized agent of the corporation and an accountant who participated in its preparation or review.

    4.

    Additional reports covering the following:

    a.

    No later than one-hundred-twenty (120) days following the close of franchisee's fiscal year, the franchisee shall submit a written report to the City Manager which shall include:

    (1)

    A summary of the previous year's activities in a format provided by the city, of all resource recovery activity conducted, including volume by type and weight and cost recovery;

    (2)

    A summary of complaints, identifying the number and nature of complaints and their disposition.

    b.

    Franchisee shall furnish to the city copies of all reports submitted to the Department of Environmental Quality or any other county, state or federal governmental agency at the same time that the reports are submitted to the agency.

    c.

    Franchisee shall furnish to the city any other information as to the sources of revenue, receipts, expenditures and financial condition of the franchisee as the city at any time may reasonably require.

    B.

    Any other information which may be reasonably required by the City for its performance of duties.

    C.

    Copies of Reports. Copies of all petitions, applications, and communications submitted by the Franchisee to the Department of Environmental Quality (DEQ) or any other Federal or state regulator, commission, or agency having jurisdiction in respect to any matters relating specifically to the operation of the solid waste management and recycling service authorized pursuant to this Franchise shall also be submitted to the City at its request.

    D.

    Cost of Reports. The cost of preparing and furnishing to the City the records and reports required by this section shall be borne by the Franchisee.

    E.

    Documentation. Documentation for the financial report required by Section 35.A above shall be made available for inspection by City without delay and at Franchisee's expense.
