§ 14-48. Nuisance wildlife.

  • (a)

    For purposes of this section, the term "nuisance wildlife" includes, but is not limited to, wild rats, nutria, raccoons, skunks, and opossums.

    (b)

    No person owning or occupying property within the city shall allow a condition to exist upon the property which attracts nuisance wildlife, gives nuisance wildlife access to food, or creates shelter accessible to nuisance wildlife. Such prohibited conditions shall include, but are not limited to the following:

    (1)

    Keeping of any animal so that feces, refuse, food or shelter associated with the keeping of the animal affords food or shelter to nuisance wildlife.

    (2)

    Allowing any accumulation of rubbish, trash, junk or other material which by reason of its decayed or unused condition affords shelter to nuisance wildlife.

    (c)

    The offense described in this section is an Independence Municipal Code Class A violation, per section 1-22.
