§ 18-167. Civil exclusion.

  • (a)

    A person is subject to exclusion for a period of 90 days from the public streets, sidewalks, public property and other public ways in the designated drug-free zone if that person has been arrested or otherwise taken into custody for either the unlawful delivery of a controlled substance pursuant to ORS 475.752, 475.81, 475.820, 475.830, 475.850, 475.860, 475.870, 475.880, 475.890, or 475.906 or for the unlawful delivery of an imitation controlled substance pursuant to ORS 475.912 within that drug-free zone.

    (b)

    If a person excluded from a drug-free zone is found therein during the exclusion period, that person is subject to immediate arrest for criminal trespass in the second degree pursuant to ORS 164.245.
